Written approval from the BOH and the Con Com is required for work such as this. It appears that it is a violation, and should be treated as such. You can issue an Enforcement Order. Consider contacting the Circuit Riders in DEP's Western Regional Office in Springfield (Sue Gillan at 413.755.2147 or Terry Eucker at (413.755.2144) for advice as to how to proceed.
